Juridical Analysis Of The Validity Of Certificate Of Land Ownership Whose Legal Basis Is Disputed In Protecting The Rights Of Heirs Study Of Supreme Court Decision Number 693 K/Pdt/2023

Abstract

The validity of land ownership certificates whose legal basis is disputed in protecting the rights of heirs is examined through a study of Supreme Court Decision Number 693 K/Pdt/2023. Using a normative method with statutory, conceptual and case approaches, the findings reveal that the issuance of land ownership certificates must fulfill cumulative formal and material requirements under Government Regulation No.24 of 1997, the protection of heirs may be pursued through an unlawful act claim under Article 1365 of the Civil Code and the Supreme Court prioritized the PPAT deed as a stronger legal basis compared to the Defendant's PRONA certificate, which was deemed legally defective.
