Legal Protection Of Heirs Over Former Cultivation Rights Land Based On Supreme Court Decision Number 6381 K/PDT/2025

Abstract

Land rights disputes are a common problem in land law practice, including in Indonesia, particularly those related to the legal status of land ownership based on the history of land acquisition. Prior to the enactment of the Basic Agrarian Law, Supreme Court Decision Number 6381 K/Pdt/2025 dealt with a land dispute involving approximately 52 hectares, stemming from a former western right in the form of an Eigendom Verponding. The parties claimed ownership of the land, while some of the land had been used for housing and other facilities. This study aims to analyze how the Supreme Court provides legal considerations and creates legal certainty regarding the status of the disputed land.
