Abstract

This journal article examines unilateral employment termination within the context of a Fixed-Term Employment Agreement (PKWT). The study aims to analyze the alignment of the judge's reasoning in Industrial Relations Court Decision Number 1/Pdt.Sus-PHI/2024/PN.Pal with Manpower Law regulations and to assess the legal protection afforded to the worker following the unilateral termination addressed in the ruling. The research employs a normative legal research method, utilizing statutory, case and conceptual approaches. The legal materials—comprising primary, secondary and tertiary sources—were analyzed qualitatively using a descriptive method. The findings indicate that the judge's reasoning was not based solely on the formal structure of the employment agreement but also took into account the actual substance of the employment relationship. The judge determined that the ongoing employment relationship no longer met the characteristics of a fixed-term agreement (PKWT), thereby resulting in a change of status to an Indefinite-Term Employment Agreement (PKWTT). Furthermore, the decision reflects the application of principles of justice and legal protection by restoring the rights of the worker who was aggrieved by the unilateral termination.
