Abstract

Debt disputes often trigger default because the debtor breaches the contract. This normative-juridical research aims to analyze dispute resolution and the justice aspect of judicial reasoning in Judgment No. 367/Pdt.G/2024/PN Mdn. The results show the lawsuit was decided by verstek due to the defendants' absence. The judge verified the debt statement as a valid under-hand deed based on Article 1875 of the Indonesian Civil Code. Defendant-I was ordered to pay the remaining loan of Rp198,850,000 and non-material damages of Rp100,000,000. In conclusion, the ruling fulfills procedural legality and provides commutative justice for the creditor. Notarial deeds are recommended for prevention.
