Abstract

This study examines the limits of the Village Consultative Body’s (BPD) oversight function in village-official dismissal procedures and options for optimizing existing conflict-handling mechanisms in Banyumas Regency. It is a normative legal study using statutory and conceptual approaches, with one interview with the Chair of the Klapagading Kulon BPD serving only as an illustrative perspective. The analysis finds that Government Regulation No. 16 of 2026 allocates dismissal steps among the Village Head, the Subdistrict Head, and the Regent/Mayor. BPD oversight allows it to request information, monitor, evaluate, express an opinion, and facilitate communication, but does not replace those decision-making powers. Banyumas’s local regulation does not reflect all stages introduced by the new Government Regulation and therefore requires harmonization; this does not establish that all local provisions have automatically ceased to apply. The study recommends harmonizing the procedure and activating existing BPD instruments and FKAKD through non-binding outputs, traceable follow-up, information safeguards, and no automatic suspension. The single interview does not prove a specific violation or the effectiveness of the proposed design.
