Abstract
The major flood that affected 19 sub-districts in Medan City at the end of 2025 revealed a discrepancy between the norms of Mayor Regulation Number 2 of 2018 and its implementation in flood management. This study aims to analyze the effectiveness of the implementation of duties and functions of the Medan City Regional Disaster Management Agency (BPBD) based on Mayor Regulation No. 2/2018 during the pre-disaster, emergency response and post-disaster phases. The research employs an empirical legal method with a qualitative approach and case study design. Data were collected through in-depth interviews with seven informants, consisting of three officials and staff of BPBD Kota Medan and four affected residents in Medan Helvetia and Medan Sunggal Sub-districts, complemented by observation and documentation. Data analysis used the Miles and Huberman model, with five indicators of legal effectiveness from Soerjono Soekanto: legal factor, law enforcement factor, facilities and infrastructure factor, community factor and cultural factor. The findings indicate that the implementation of Mayor Regulation No. 2 of 2018 has not been fully effective. This is identified from the limited number of field personnel (60 personnel for 19 sub-districts), limited evacuation facilities (8 drifting rubber boats and 3 motorized boats), socialization reach that only covered three sub-districts, uneven community selfpreparedness and the habit of dumping waste into rivers that is still found in some areas. Based on these findings, this study recommends strengthening human resource capacity, increasing facilities and infrastructure, optimizing the early warning system and strengthening the Kelurahan Tangguh Bencana program.
