Main Article Content
Abstract
This study aims to analyze the development of breach-of-contract cases handled through the small claims procedure at the Pasir Pengaraian District Court from January 2022 to September 2026, as well as to interpret case patterns and challenges in their resolution. The study employs an empirical legal research method with a descriptive-analytical approach. Data were obtained through a review of the Case Tracking Information System and semi-structured interviews with one court official and two advocates. The data were analyzed descriptively to identify annual trends in the number of cases and were then integrated with the interview findings to provide context for understanding dispute patterns and evidentiary issues. The results indicate that the SIPP records a total of 106 breachof-contract cases during the observation period, with the highest number recorded in 2024, comprising 47 cases (44.34%). The data reveal that the number of cases fluctuated across years and was unevenly distributed. The interviews identified disputes involving payment obligations arising from credit, financing and lending relationships. Challenges in resolving these disputes include unclear calculations of outstanding arrears, discrepancies in payment records and incomplete supporting documentation. This study provides an empirical overview of the dynamics of breach-of-contract cases under the small claims procedure and highlights the importance of consistent case data, clear contractual obligations and sufficient evidence in the resolution of civil disputes.
