Legal Review In The Process Of Resolving The Criminal Offense Of Theftangelo

Abstract

This study examines the implementation of restorative justice from the perspective of the latest Criminal Procedure Code (KUHAP), particularly regarding the procedures and requirements for applying restorative justice mechanisms in the resolution of criminal cases. The new KUHAP reflects a paradigm shift from a retributive approach to criminal punishment toward a resolution-oriented approach that emphasizes victim recovery, offender accountability and the achievement of reconciliation. This study aims to analyze the normative provisions concerning the stages of implementation, requirements, forms of restitution and limitations on cases that may be resolved through restorative justice. The results of this study are expected to provide an understanding of legal certainty and the effectiveness of restorative justice implementation within Indonesia's criminal justice system.
