Legal Analysis Of Trademark Transfer Agreement Dispute In Decision Number 74/Pdt.Sus-Hki/Merek/2023/Pn Niaga Central Jakarta

Abstract

This study analyzes the validity of the trademark transfer agreement and the legal considerations of the panel of judges in Decision Number 74/Pdt.SusHKI/Merek/2023/PN Niaga Central Jakarta. The study uses normative legal methods with a statutory regulatory approach and case studies. The results indicate that the transfer agreement does not meet the legal requirements under Article 1320 of the Civil Code because it involves a deceased party. The judge's decision reflects legal certainty and protection for rights owners and emphasizes the importance of more thorough administrative verification in the transfer of trademark rights.
